High court in Kampala orders Electoral Commission to nominate Peter Agaba
The High court in Kampala has today(Wednesday) ordered the Electoral Commission to nominate Peter Agaba as a Candidade for Ibanda Municipality parliamentary seat.
The Electoral Commission had declined to nominate Agaba on 5th/June/2018, on grounds that his nomination papers were not accompanied with the evidence of academic qualifications as required by the Parliamentary Election’s Act-2005.
As a result, Agaba petitioned Court through KTA Advocates, arguing that he appeared for nomination on the said date with all the required documents, and the Returning Officer refused to nominate him, simply because he didn’t have originals of academic papers.
However in his ruling today ,Justice Musa Ssekaana said this was wrong, and noted that the presentation of photo copies does not render a person holding them unqualified, since the Provision of the law that requires establishing academic qualification doesn’t require production of the originals as the Returning Officer demanded of the Petitioner.
Speaking to Rwenzori fm,Eiraka radio, Agaba confirmed the news and assured his supporters that he will be nominated on Friday, this week.
We caught up with some of his supporters here at his office in Ibanda, and they expressed joy,saying they will entirely support him to victory.
Meanwhile, the same Court declined to order the nomination of Mulinde Deusdedit, for the MP seat of Ibanda Municipality, saying he turned up at the nomination venue not prepared as he arrived at the nomination venue on 5th/June/2018 at 4:30pm without all the requirements yet nominations were to close at 5pm.
The Judge ordered Mulinde to pay the Electoral Commission all the costs it has incurred in defending this case.
